Right of cancellation

Sales of goods over the Internet are regulated by Legislative Decree no. 185 of 22/05/1999 which governs distance contracts, in other words contracts made outside commercial premises.
This legislation grants the right of cancellation, whereby the consumer is entitled to return the goods purchased and obtain a refund of the amount paid.
This right is reserved solely for physical persons (consumers), and so cannot be exercised by legal persons and physical persons acting in a professional capacity.
In order to exercise the right of cancellation, a communication must be sent within 10 working days of receiving the goods, expressing the decision to withdraw from the contract.
The right of cancellation does not apply to sealed products opened by the consumer. The only costs incurred are those required to return the product.
The right of cancellation is forfeited in full if the product returned is not intact, or: is missing the original packaging
any of the additional product parts are missing (accessories, box, descriptive notes, etc)
the product is damaged for reasons other than transport.

Procedure for exercising the right of cancellation

If you have made a purchase from our site and you wish to cancel the purchase, you will have to follow this simple procedure: send a recorded delivery letter with advice of receipt to the business that has offered the products for sale covered by the right of cancellation, within 10 working days of receiving the goods.
E-mail the communication in advance to the business, and copy to art@operasacra.com.
Using your chosen courier, send the product carefully wrapped in its original packing and complete with all accessories, the instruction manuals and all the original items contained therein.
Insure against theft and transport-related damage and pay the related costs.
The business that has sold the product will refund the cost of the goods consigned and the initial consignment costs by means of a bank transfer.
For this reason please indicate your bank details directly on the cancellation form when this is sent by recorded delivery.

Inherent defects

Pursuant to Legislative Decree no. 24 of 02-02-2002, the business that has sold the products through the service offered by www.operasacra.com is liable in respect of the consumer for any inherent defects existing at the time the goods are consigned.
An inherent defect can relate to:
transport-related internal damage not found on receipt;
wrong consignment;
The guarantee will be applied to the product exhibiting inherent defects and/or malfunctions not identifiable at the time of purchase, provided that the product is used correctly and with the due diligence, in other words in accordance with its intended use and any other requirements indicated in any technical documentation, in compliance with the various operating standards specified therein.
This guarantee will not, however, be applicable in the case of negligence, careless use and inadequate maintenance of the product.
In the event of inherent defect, the consumer is entitled to have the product's conformity restored, at no cost, by means of repair or replacement.

Guarantees

All products sold on www.operasacra.com are covered by the official guarantee of the vendor/producer as regulated, when applicable, by Legislative Decree no. 24 of 02-02-2002.
This guarantee will be applied to products exhibiting inherent defects and/or malfunctions not identifiable at the time of purchase. The guarantee is personal and will hence be applied solely to the original purchaser, being reserved to direct customers and not to traders and retailers.
